These Terms of Service ("Terms") govern your access to and use of Wakeeza.com (the "Platform", "we", "us", "our"), operated by Wakee Digital (Registration Number 2021 / 705788 / 07), registered at Stand No. 88, Manzini Trust, White River, 1240, South Africa. By registering for, accessing, or using the Platform, you ("Member", "you") agree to be bound by these Terms, our Privacy Policy, Fair Play Policy, Escrow & Payment Terms, Refund & Dispute Resolution Policy, and Acceptable Use Policy, all of which are incorporated by reference.
Wakeeza.com is a peer-to-peer marketplace that connects job seekers, service providers, product sellers, and clients. We are a facilitator, not a party to any transaction, agreement, service, or sale between Members. We do not manufacture, inspect, own, sell, resell, or provide the products, services, or jobs listed on the Platform, and we make no warranty as to the quality, safety, legality, or fitness of any listing. Our escrow function (see our Escrow & Payment Terms) is provided solely to facilitate secure payment handling between Members and does not make us a party to, or guarantor of, the underlying transaction.
You retain ownership of content you post (listings, images, messages, reviews) but grant Wakeeza.com a non-exclusive, royalty-free, worldwide licence to host, display, and distribute that content for the purpose of operating the Platform. You agree not to post unlawful, misleading, infringing, or prohibited content (see our Acceptable Use Policy for full detail) and not to circumvent the Platform by taking a connected transaction off-platform to avoid fees.
Use of certain features (listing fees, commissions, escrow fees) may incur charges disclosed to you at the time of the transaction, in South African Rand (ZAR). Fees are non-refundable except as set out in our Refund & Dispute Resolution Policy. Payment processing is handled by our appointed third-party payment service provider; by transacting on the Platform you also agree to that provider's applicable terms.
The Platform is provided "as is" and "as available". To the maximum extent permitted by South African law, we disclaim all warranties, express or implied, regarding the Platform's operation, the conduct of Members, or the outcome of any transaction. We do not guarantee uninterrupted or error-free operation of the Platform.
To the maximum extent permitted by law, Wakeeza.com's aggregate liability arising out of or relating to these Terms or your use of the Platform shall not exceed the total fees you paid to us in the six (6) months preceding the claim. We are not liable for indirect, incidental, or consequential losses, or for the acts or omissions of other Members. Nothing in these Terms limits liability that cannot lawfully be limited under South African consumer protection law.
You agree to indemnify and hold Wakeeza.com harmless from any claim, loss, or damage arising from your breach of these Terms, your content, or your interactions with other Members.
We may suspend or terminate your account at our discretion for breach of these Terms, suspected fraud, or unlawful activity, with or without notice where urgency requires it. You may close your account at any time by contacting support@wakeeza.com, subject to the resolution of any pending transactions.
These Terms are governed by the laws of the Republic of South Africa. Disputes between Wakeeza.com and a Member will first be attempted to be resolved informally; unresolved disputes fall under the jurisdiction of the South African courts, without prejudice to any rights you have under the Consumer Protection Act, 68 of 2008, or to refer a matter to the National Consumer Commission.
We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. Material changes will be flagged on the Platform.
